1. Acceptance of terms
By accessing or using the Clooshi platform ("Clooshi", "we", "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use the platform. These terms form a legally binding agreement between you and Clooshi Ltd, a company registered in England and Wales.
2. Description of service
Clooshi is an online marketplace that connects families ("Families") seeking home services with independent service providers ("Providers"). Clooshi facilitates discovery, communication, booking, and payment but is not itself the provider of any home services.
3. Marketplace model and no employment relationship
Providers on Clooshi are independent contractors. They are not employees, workers, or agents of Clooshi. Families are not employers of Providers through their use of the platform. Clooshi does not direct, supervise, or control the work performed by Providers. Each Provider is responsible for their own tax, National Insurance, insurance, and compliance with applicable law.
4. User accounts
You must be at least 18 years old and capable of entering into a legally binding contract to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. You agree to provide accurate, current information and to keep it up to date.
5. Booking and payment terms
Bookings are negotiated and agreed directly between Families and Providers through the platform. Payment is taken at the time of booking and held securely by Clooshi (or our payment partner) and released to the Provider after the service is completed and confirmed. Clooshi charges a service fee, disclosed before booking confirmation. All prices are in pounds sterling (GBP) unless stated otherwise.
6. Cancellation policy
Cancellations made by a Family more than 24 hours before the scheduled service receive a full refund of the booking amount, less any non-refundable processing fees. Cancellations within 24 hours may incur a charge of up to 50% of the booking value, payable to the Provider. Providers who cancel without reasonable notice may have their account suspended.
7. Prohibited conduct
- Using the platform for any unlawful purpose or in breach of these terms.
- Circumventing Clooshi to arrange or pay for bookings off-platform after being introduced through the service.
- Posting false, misleading, defamatory, or discriminatory content.
- Harassing, threatening, or abusing other users.
- Submitting false documents, identities, or reviews.
- Interfering with the operation or security of the platform.
8. Intellectual property
All content, trademarks, and software on the Clooshi platform are owned by or licensed to Clooshi Ltd and are protected by intellectual property laws. You are granted a limited, non-exclusive, revocable licence to use the platform for its intended purpose. You may not copy, modify, distribute, or reverse engineer any part of the platform without our prior written consent.
9. Limitation of liability
To the maximum extent permitted by law, Clooshi is not liable for any indirect, incidental, special, or consequential losses arising out of or in connection with your use of the platform. Clooshi is not responsible for the acts, omissions, or quality of work of any Provider, nor for any dispute between Families and Providers. Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.
10. Indemnity
You agree to indemnify and hold Clooshi harmless against any claims, damages, or expenses arising out of your breach of these terms or your use of the platform.
11. Suspension and termination
We may suspend or terminate your account at any time if we reasonably believe you have breached these terms or pose a risk to other users. You may close your account at any time by contacting us.
12. Changes to these terms
We may update these terms from time to time. Material changes will be notified to you by email or through the platform. Continued use after changes take effect constitutes acceptance.
13. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute arising out of or in connection with these terms.
